  • Who Can Be Held Liable for a Texas Criminal Assault?

    When it comes to liability, every assault is different. The third parties that may be liable will depend on where the assault took place and under what circumstances. Whether the assailant was an employee who was “on the clock” when the attack occurred and whether the assailant was intoxicated at the time of the incident are also factors that will need to be carefully investigated and documented.     • Employers. The employer of the assailant could be held liable if the assault was committed within the scope of their employment. Alternatively, if the assault occurred at work, your employer could be liable for negligent security if it can be proven they failed to take steps to maintain a reasonably safe working environment.

    • Security personnel. Liability could arise if they overserve alcohol to a visibly intoxicated individual who subsequently commits an assault or if they fail to address aggressive behavior promptly.
    • Parents or guardians. In certain situations, parents or legal guardians can be held liable for the actions of their minor children.
  • My Assailant Wasn’t Convicted of Criminal Assault. Can I Still Sue to Recover Damages?

    It does not necessarily matter if your assailant was not formally criminally charged, if the charges were dropped, or if they were ultimately acquitted in a criminal court. You still have the right to sue them (as well as other liable third parties) and seek damages.

    The criminal justice system and the civil justice system operate independently, and the standards of proof required in each are different. However, in a civil lawsuit, you only need to prove your case by a "preponderance of the evidence," meaning it is more likely than not that the defendant is liable.
